Consumers’ Right to Healthy Food
Fifteenth March of Every year has been recognized as the World Consumer Rights Day and consumer groups, consumer activists, organizations lobbying for the rights of the consumers commemorate this day of the year campaigning towards protecting the rights of consumers under a common theme. The Consumers’International has declared this year’s theme as the Consumers’ right to healthy food; a very timely and highly relevant topic for the safety of the consumers. According to the statistics poor diets contribute to more than 11 million deaths annually and one of the main risk factors for death. Diet related diseases such as cancer, cardiovascular disease and diabetes are rising faster in developing economies. Therefore it is high time that all relevant parties work together, identify and implement necessary changes to be introduced to the way people eat.
In Sri Lanka several regulations have been introduced by the government in order to ensure food safety. Food Advisory Committee established under the Food Act is the main body   established to take policy decisions related to food and this committee is represented by the relevant stakeholders such as Sri Lanka Standards Institute, Government Analyst Department, City Analyst, Medical Research Institute, Department of customs, Chamber of Commerce, Consumer Affairs Authority etc. Several measures such as import inspection, mandatory labeling, mandatory standards, product registration, product testingetc.has been introduced for the food items. Even though there are several measures in place there are complaints from consumers on quality of food sold in the market.  Further there are frequent media releases on marketing of unhealthy food to the consumers which are not suitable for human consumption. Therefore it is necessary to review the effectiveness of the regulatory measures, identify the drawbacks and to introduce new strategies to ensure the quality of food marketed to the consumers.
Being the government regulatory Authority established to protect the consumers and promotion of healthy competition, the Consumer Affairs Authority is envisioned to perform several functions with regard to safeguarding the consumers such as consumer Education and Empowerment, conducting market raids and investigations, consumer redress, regulation of the prices of specified items and promotion of healthy competition.
With regard to consumer education and empowerment, the CAA conduct awareness sessions for  target groups such as school children, university students, house wives, members of civil society organizations and general public. These sessions are conducted on rights and responsibilities of consumer, how they can obtain the assistance of the Consumer Affairs Authority to be a rational consumer in the market etc. The CAA has identified house wives as one of the key target groups to make aware on consumer related matters since most of the household decisions are taken by them. The CAA conducts one day workshops for members of women’s organizations on useful topics such as “role of women in keeping the family healthier”, “how to utilize the household income effectively” etc. Through these workshops the CAA attempts to educate women on their consumer rights and responsibilities and try to mobilize them in to more empowered consumers who are capable of taking better decisions in the market.   
The CAA promotes the establishment of school consumer circles in the schools and Consumer Societies within the civil society in order to promote participation of consumer groups in consumer related issues.  The CAA has introduced consumer study projects to the consumer circles in order to get the students active involvement. These projects are introduced at the workshops conducted for school children on the theme “Action on Consumer Rights”
The CAA conducts market surveillance in order to protect consumers from hazardous products and unfair trade practices. During thesemarket surveillances our officers have detected food items which are unfit for human consumption. Adulteration of food items (spices with textile dyes, coconut oil with industrial palm oil, white rice with dye, mixing of “sathakuppa” seeds with cumin seeds etc.), changing of the information in labels especially expiry date (cooking oil, canned fish, sausages, chocolates etc.),refilling with used containers (Bottled water), misleading trade practices (extracting certain % of essential oils from coriander seeds before sending  the market) are some of the malpractices our officers were able to detect in the market. The offenders are prosecuted in the Magistrate courts and fines imposed based on the provisions in the Act.
In addition to the market raids the CAA collect samples of food items and test for quality parameters. These samples are collected from the market and send to the laboratories such as Government Analyst, City Analyst, Medical Research Institute (MRI), Industrial Technology Institute (ITI) and Sri Lanka Standards Institute (SLSI) for obtaining analytical reports. Some examples of such testing are added sugar content of ready to drink beverages, salt content of snacks available in the market, fat content of fast food,testing of bottled water for chemical and micro biological properties, testing of spices for adulterants, testing of vegetables for pesticide residues, testing of pulses for agro chemicals, testing of coconut oil for adulterants and Aflatoxin.Once the test reports received steps are taken to make aware the industry on necessary corrective  action if there is any quality related issue detected.
Working experience shows that the monitoring mechanisms of the regulatory authorities are not sufficient enough to eliminate the malpractices happening through the supply chain. The surveillance mechanism is not potent enough to   cover up the entire country. Further the business community is not sensitive enough to respect the rights of the consumers and their safety. Most of the business community is short term profit oriented and lack concern on a better customer service. Business community has poor respect towards consumer rights. Insufficient testing facilities to get analytical reports on food items are another challenge faced by the regulators. Most of the testing labs are not accredited and therefore the reports can be challenged. Therefore, more emphasis has to be placed in developing and promoting   accredited laboratory network which is capable to address the needs of the food industry as well as the regulators. Further, Sri Lanka has to give due consideration on development of a state of the art food storage system in order to ensure food safety and food security for its people.  
Prosecution of offenders is a reactive measure to ensure food safety and a less effective method in the long term. If so, what are the more effective methods to ensure healthy food to consumers? Promoting the industry for self-regulation is one option.But further thoughts are necessary on the level of success as a developing country.Moreover it is necessary to persuade the consumers that they have to be vigilant on what they purchase. Whetherthe product is labeled properly, whether the expiry date is correctly mentioned, whether the product is free from external damages etc. must be carefully examined by the consumers before purchasing food items. If there are organized consumer groups, testing of food items can be done and more consumers can be educated on the contents of food etc. Further they can do market surveys on products. If the consumer movement is more powerful the business community will be flexible and listen to the requirements of the consumers and pay respect to the rights of the consumers. Consumers’ right to healthy food can only be achieved through collective efforts of government (regulatory, testing, training authorities), members of food industry (manufacturers, importers, distributors, wholesalers and   retailers) and the consumers.

Expression of interest for the implementation of a technology based consumer and domestic market protection project

Expression of Interest for the Implementation of a Technology based CONSUMER AND DOMESTIC MARKET Protection Project

Scope of the Project

The Consumer Affairs Authority has decided to implement a technology based consumer protection project in order to ensure consumer safety and to safeguard the authentic manufacturers from counterfeits coming to the market. It is necessary to ensure that genuine products are being received by consumers through the marking of each locally produced or imported product. In addition implementation of this project must comprise advance track and trace technology which will provide the necessary evidence for consumer action against unfair and illegal trade practices.

The Consumer Affairs Authority is inviting Expressions of Interest from suitably qualified suppliers with proven experience in the implementation of a turnkey solution including (as a minimum) but not limited to the following:

  1. Security Stamps: The secure solution has to be designed on the basis of highly secure stamps. These stamps will have to be composed of material and information security layers, which would provide consumers, investigation officers of the CAA, producers, importers, wholesalers, distributors and retailers with the means of conducting effective product authentication. Secure stamps shall be uniquely identifiable by an invisible machine readable code and shall be printed with non-commercially available secure inks.

  2. CAA Database and Inline Production Monitoring: Each secure stamp applied on the product shall be linked to the CAA data management system (” Database”). In case of automated high volume production the secure stamps shall be applied and authenticated during product manufacturing without disrupting established production processes giving the CAA near real time visibility of each manufactured product. The Database has to be installed in a secure government site and equipped with the necessary systems to collect, store, track and trace information pertaining to each and every product. This Database shall allow CAA to monitor individual stamps and identify incoherencies in their usage. It shall provide services and centralised data storage for the system which is to include stamp coding and delivery, production monitoring, field inspections and reporting functionalities. The Database shall be accessible for the authorized users through secured web interfaces for system operations and reporting activities. Consumers shall also be able to verify and trace product related information via a dedicated website connected to the Database.

  3. Secure Hand-Held Inspection Devices: CAA investigation officers shall be equipped with secure hand-held devices allowing immediate product authentication through embedded material and information based security features of the secure stamps. The device shall communicate with the CAA database via a wireless mobile network which retrieves and traces all information associated with each inspected product.

Eligible Suppliers having a proven track record of successful implementation of similar projects are invited to submit their Expressions of Interest including the following documents:

  1. Name, address and legal status of supplier.
  2. Preliminary solution proposal based on scope of project outlined above.
  3. Self Declaration certifying that Supplier is not a manufacturer, importer, distributer or wholesaler of any fast moving consumer goods.
  4. Self Declaration with supporting evidence certifying that Supplier has a) at least 5 (five) years of continuous experience in operating integrated traceability and secure product marking systems with web based monitoring system for national governments b) minimum of 5 (five) contracts with national governments in the last 10 (ten) years with each contract covering a minimum volume of 500 million products annually c) at least 2 (two) reference letters from other national governments for similar operational projects.
  5. Copies of certifications in security, information handling and best in class management through proof of the Certification ISO 9001, Certification ISO 14001, OHSAS 18001 or equivalent.
  6. Documentary evidence that Supplier and/or the Group of companies the Supplier belongs to a) holds in assets more than 5 billion LKR, thus demonstrating the required financial capability to undertake all development and implementation costs for the proposed project b) has an annual turnover of over 1 Billion LKR for each of the last 3 (three) consecutive years thus demonstrating required recurring cashflow for operation of the proposed project.

Deadline for submission of EOI: 12:00 noon; local time on Monday 9th of December 2013

Applications not received within the above mentioned deadline shall not be accepted for evaluation irrespective of circumstances. All expenses required for preparation and submission of the response to this EOI and provision of any additional information shall be entirely incurred and borne by the applicant. This EOI does not entail any commitment on the part of the CAA, either financial or otherwise. CAA reserves the right to accept or reject any or all EOI without incurring any obligation to inform the affected applicant(s) of the grounds/reasons.

The Training Work Shop for the Staff of CAA

The Training Workshop on Consumer Health and Safety Matters Conducted for the Staff of Consumer Affairs Authority Will be held on tomorrow (18-11-2014) at the Main Auditorium of the Industrial Technology Institute, Colombo 07.

Workshop of empowering women in rights and responsibilities

With the purpose of building a society which is well consisted with consumer rights & responsibilities consumer affairs & information division of consumer affairs authority had organized by one day workshop on 31st October 2013 from 9.00 am to 4.00 pm at Sri Lanka foundation institute, for the members of selected women’s organization.

For these workshop participated under the below invited guests. Mr. G.K.D. Amarawardena secretary ministry of co-operative & internal trade, Miss. Kanthi Perera secretary ministry of Educational services, Miss. Princy Jayathumga secretary ministry of parliamentary Affairs, Mr. J.M. Mangalathissa Additional secretary ministry of co-operative & internal trade, Miss. Renuka Ekanayake Additional secretary ministry of Technology & Research, Mr. Roomy Murshook Chairmen consumer Affairs Authority, Mr. Milton Amarasinghe, Sunil Jayaweera Executive directors of consumer Affairs Authority, Mr. J.M.A. Duglas Director General consumer Affairs Authority, Mrs. Chandrika Thilakarathne director CA& I All other Directors & Deputy directors in the consumer Affairs Authority, Officers of the All district office an also members of the selected women’s organization.

Mrs. Chandrika Thilakarathne director CA & I consumer Affairs Authority was addressing the gathered on Rights and responsibilities of consumer and in what ways the CAA assist in safeguarding consumers. Dr. Shanthi Gunawardena Head of the Nutriotion coordination division Ministry of health was addressing the gathered on Basic nutrition facts that you must be Aware in Keeping your family healthy. Waruni Perera cooking presenter was addressing the gathered on practical session on how to prepare a healthier breakfast for your family in short time and for low cost. Ms. Samadani Kiriwandeniya (chairperson SANASA) was addressing the gathered on in what ways the correct decision making in the market was contribute effective management of home economy. Finally Miss. Samantha Karunarathne deputy director CA & I consumer Affairs Authority was addressing the gathered on how can you raise your voice as members of an active consumer organization.

The main objective of this workshop was to enhance the knowledge of women in Colombo districts on consumer rights & responsibilities. This program will be conducted island wide in future with the purpose of establishing a well protected consumer society.
