Women Consumer Activists of Colombo District

An awareness program was held by CAA for Women Consumer Activists of Colombo District on 15th September 2016 at Sarvodaya Nagarodaya centre.
Mr. Nandasiri Gamage, General Manager of SL women’s cooperative societies, Mr. A M Yoosuf, Consultant CAA, Mr. AKDDD Arandara DG. CAA, participated as chief guests and Dr. Palitha Saman Jayakody Health Education Unit- Wathupitiwala Base Hospital, Mrs. CN Thilakatartne Director-CAA, Mrs Samantha Karunaratne DD-CAA, Shakila Weerasinghe AD-CAA, conducted the awareness sessions with great success.

Consumer Affairs Authority is in the alert on sellers

Consumer Affairs Authority advises consumers to be very careful when purchasing electrical equipment, bulbs and related decorative items used for decorations in celebration of Vesak Festival.

Dr. Lalith N Senaweera, The Chairman, Consumer Affairs Authority points out that it is much possible to sell electrical equipment, wires, and related items without good standard and guarantee at the time of Vesak Festival.

He advises to pay special attention on the following matters when purchasing electrical equipment and accessories for the decorations in celebration of Vesak Festival.

At the sale of all the electric or electronic equipment manufacturers, sellers, importers and suppliers shall ensure a guarantee period not less than six months from the date of selling or the date that buyer owns the good and the conditions of the guarantee certificate shall be in Sinhala, Tamil and English languages.

• All the manufacturers, importers, distributors and sellers shall not manufacture, import, distribute, store or as in retail or wholesale or display for sale the following items if they are below 250v, unless they bears Sri Lanka Standards (SLS) mark.

• Plugs with exchangeable wires and unexchangeable wires
• Switched and unstitched socket outlets with switches or without switches , electrical extension cords and portable socket outlets
• Adaptors and single transformer adaptors
• Fused coordination units (switched and unswitched)
• Fused transformer plugs
• Cable reels fixed with plugs and socket outlets

• SLS certification is compulsory for below mentioned locally manufactured electricity wires.

• SLS 733- PVC insulated, non-armoured cables with cooper conductors, for voltages up to and including 450/750V, for electric power, lighting and internal wiring
• SLS 1143 Electrical flexible cords rated up to 300/500 V, for use with appliances and equipment intended for domestic, office and similar environments.

பாவனையாளர் அலுவல்கள் அதிகாரசபை எதிராளி

அநுராதபுரம் மேலதிக நீதவான் நீதிமன்றம் பாவனையாளர் அலுவல்கள் அதிகாரசபை எதிராளி எஸ்.ஜே.கொம்பியூட்டர் இன்ஸ்ரிரியூட்

இந்த வழக்கானது அனுராதபுர மாவட்ட செயலகத்தின்  பாவனையாளர் அலுவல்கள் அதிகாரசபையினைச் சேர்ந்த புலனாய்வு உத்தியோகத்தர்களினால் மேற்கொள்ளப்பட்ட திடீர் சோதனையின் போது தாக்கல் செய்யப்பட்டது. இது தொடர்பில் குறித்த உத்தியோகத்தர்களினால் எஸ்.ஜே.கொம்பியூட்டர் இன்ஸ்ரிரியூட்டிற்கு வருகை தந்து ருபா 450.00 பெறுமதியான சக்கர கணனிப் பொறியினை (optical wheel mouse) செய்துள்ளதுடன் பற்றுச்சீட்டில் உத்தரவாத காலப்பகுதிக்குரிய கூடானது குறுக்குக் கோடிடப்பட்டிருந்தது.
பாவனையாளர் அலுவல்கள் அதிகாரசபையானது பாவனையாளர் அலுவல்கள் அதிகாரசபைச் சட்டத்தின் 10(1) ஆம் பிரிவின் கீழ் தொழிற்படுகின்ற, இலங்கை ஜனநாயக சோசலிச குடியரசின் 2011 ஒக்டோபர் 04 ஆம் திகதிய 1726/16 ஆம் இலக்கத்தினால் பிரசுரிக்கப்பட்ட 37 ஆம் இலக்க கட்டளையின் படி, அனைத்து மின்சார மற்றும் / அல்லது இலத்திரனியல் பொருட்கள் / சாதனங்கள் / துணைப் பொருட்களுக்கு ஆகக்குறைந்தது  6 மாத காலப்பகுதிக்கேனும் உத்தரவாத காலப்பகுதியினை வழங்குமாறு அனைத்து மின்சார மற்றும் / அல்லது இலத்திரனியல் பொருட்கள் / சாதனங்கள் / துணைப் பொருட்களின் தயாரிப்பாளர்கள் / வியாபாரிகள் / இறக்குமதியாளர்களுக்கு கட்டளையினைப் பிறப்பித்துள்ளது
எவ்வாறாயினும், குறித்த விற்பனையாளர் சக்கர கணனிப் பொறியினை (optical wheel mouse) உத்தரவாத காலத்தினை வழங்காது விற்பனை செய்துள்ளமையினால், பாவனையாளர் அலுவல்கள் அதிகாரசபையானது குறித்த வியாபாரிக்கெதிராக நீதிமன்றத்தில் வழக்குத் தாக்கல் செய்திருந்தது. பாவனையாளர் அலுவல்கள் அதிகாரசபையின் சார்பில் இரண்டு சாட்சிகள் சாட்சியமளித்துள்ளதுடன் பிரதிவாதி அவரது தரப்பில் சாட்சியாக நீதிமன்றில் ஆஜராகியிருந்தார். நீதிமன்றமானது சாட்சியங்களினை கவனத்தில் கொண்டுள்ளதுடன் எவ்வித நியாயமான சந்தேகமுமின்றி பிரதிவாதி 6 மாத உத்தரவாத காலத்தினை வழங்காது சக்கர கணனிப் பொறியினை (optical wheel mouse) விற்பனை செய்துள்ளதை சந்தேகத்திற்கிடமின்றி தீர்மானித்துள்ளதுடன் பிரதிவாதியானவர் குற்றவாளியாக இனங்காணப்பட்டார். அதற்கிணங்க, நீதிமன்றமானது ரூபா.3000/- இனை தண்டப்பணமாக விதித்து கட்டளையினைப் பிறப்பித்தது.

பாவனையாளர் அலுவல்கள் அதிகாரசபை எதிராளி நியூ சண் டிரேடிங் தனியார் லிமிட்டட் 

இந்த வழக்கானது நியூ சண் டிரேடிங் தனியார் லிமிட்டடிலிருந்து கொள்வனவு செய்யப்பட்ட டெல் மடிக் கணனியானது அதன் உத்தரவாத காலத்தினுள் ஏற்பட்ட பழுதுகள் தொடர்பில் பாவனையாளர் அலுவல்கள் அதிகாரசபையினால் பெறப்பட்ட முறைப்பாட்டின் அடிப்படையில் தாக்கல் செய்யப்பட்டதாகும்.
சட்டத்தின் 13(1) ஆம் பிரிவின்படி, பாவனையாளர் அலுவல்கள் அதிகாரசபையினால் இரண்டு தரப்புக்களும் அழைக்கப்பட்டு விசாரணையினை மேற்கொண்டிருந்தது. அதன்பின்னர் வெளிவந்த விபரங்களின்படி, பாவனையாளர் அலுவல்கள் அதிகாரசபையானது, பாவனையாளர் அலுவல்கள் அதிகாரசபைச் சட்டத்தின் 13(4) ஆம் பிரிவின் படி, மடிக் கணனியினைக் கொள்வனவு  செய்த பாவனையாளருக்கு ஏற்பட்ட செலவினைத் திருப்பி வழங்குமாறு குறித்த வியாபாரிக்கு கட்டளையிட்டது.
எவ்வாறாயினும், குறித்த வியாபாரியானவர் மேற்குறித்த கட்டளையினை புறக்கணித்தமையினால் பாவனையாளர் அலுவல்கள் அதிகாரசபையானது சட்டத்தின் 13(6) ஆம் பிரிவின்படி குறித்த கட்டளை தொடர்பில் நடவடிக்கையெடுக்குமாறு கொழும்பு நீதவான் நீதிமன்றில் கோரிக்கையொன்றினை முன்வைத்தது. அதற்கிணங்க, நீதிமன்றத்தினால் அக்குறித்த வழக்கானது 2016.05.05 ஆம் திகதியன்று விவாதத்திற்கு எடுத்துக் கொள்ளப்பட்டதுடன் எதிராளி ருபா.79,000/- இனை மடிக் கணனியினைக் கொள்வனவு செய்தவருக்கு வழங்க வேண்டுமென்றும் குறித்த பாதிக்கப்பட்ட தரப்பானது பழுதுகளுடன் கூடிய அத்தகைய மடிக் கணனியினை மேற்குறித்த விற்பனையாளருக்கு மீளவும் கையளிக்க வேண்டுமெனவும் கட்டளையிட்டது.
